CHIEF MAGISTRATE – MUNICIPAL COURT
Salary Range: $70,553 - $ 97,676
The Chief Magistrate is responsible for the day to day operations of municipal court, and the daily supervision and development of magistrates within Alabaster municipal court department. This position coordinates and supervises the work of staff ensuring efficient workflow and opportunities to increase efficiencies while providing services to the citizens we serve.
General duties include:
Serves as the Department Head and liaison between the City Clerk’s office, Court (including Judge and Prosecutor) and the Police Department. Ensures compliance with all laws related to initial appearance and probable cause hearings for defendants. Supervises receipt and docketing of funds, daily bank deposits, and accounting for funds; verifies daily payments and deposits; ensures deposits are made to appropriate funds; reports financial data to finance department and various state agencies; supervises collection of past due payments to court and service of writs of arrest; supervises receipt of cash bonds and monitors disposition of same. Establishes probable cause regarding the issuance of warrants and/or summons; writes, authorizes, and issues warrants following procedures established by law; takes depositions and testimonies from citizens for warrants; maintains records of all warrants issued. Enters citations issued by law enforcement personnel; takes sworn oaths from officers; conducts initial appearance proceedings for prisoners; sets bail in accordance with applicable laws and regulations; accepts and records pleas into the court; determines fines based on standards established by state and/or local laws; receives money assessed for bonds, fines and forfeitures; records money received to the correct case number; issues receipts on fines received; enters payments into computer; sets court dates; dismisses cases; files documentation in a systematic manner to ensure ease of retrieval; forwards applicable documentation to other judicial and law enforcement agencies for notification purposes. Issues subpoenas to victims, complainants or witnesses for trials on cases. Supervises organization and preparation of court dockets and all necessary forms and files; reviews documents processed by subordinates to ensure accuracy; discusses errors and recommends methods for correction action. Responsible for obtaining language and deaf interpreters; ensure interpreters and appointed attorneys are paid according to state guidelines. Assists the Judge and Prosecutor before, during, and after court as needed. Performs domestic violence hearings within prescribed time limits. Receives, records, reviews, composes, and approves legal records, documents, forms and requests; records, processes and forwards records to appropriate departments and agencies; ensures documents are filed and maintained for ease of retrieval and utilization by the court. Balances monies received against receipts daily and monthly; researches any errors detected and corrects accordingly; presents daily deposits to the Court Clerk; prepares monthly reports for the Court Clerk. Performs the suspension of Driver Licenses in accordance with state law; issues notice to the Department of Public Safety in cases of suspension or reinstatement. Determines whether a case qualifies for defensive driving school; schedules and enrolls defendants; collects money; performs closeout and adjudication of cases upon completion. Monitors DUI cases assigned to an interlock program; collect payments; communicate program participation to judge; monitors pre-trial diversion defendants. Sets forfeiture hearings for bonding companies and collects monies on forfeited bonds. Assists the public by providing information, researching court dates, advising procedures, and directing to other departments/agencies. Maintains a comprehensive, current knowledge and awareness of applicable laws/regulations; attends professional workshops and training. Prepares monthly reports for auditors; prepares monthly and yearly reports for the Administrative Office of Courts. Regular & predictable attendance is a required essential function of the position based on department established work schedule.

Minimum Qualifications:
Bachelor’s degree in criminal justice, political science, pre-law or a related field with five (5) years’ experience or an equivalent combination of education and experience. Must become certified as a National Crime Information Center computer operator. Must possess and maintain certification as a Municipal Court Magistrate. Must be eligible to be certified as a Notary Public. Must possess and maintain a valid Alabama driver’s license.
Knowledge / Skills:
Knowledge of applicable federal, state, and local laws and ordinances, Alabama Rules of Judicial Administration and Criminal Procedure.
